在(zai)某些(xie)情形下,職(zhi)工(gong)受到(dao)傷(shang)害與其工(gong)作(zuo)不存在(zai)直接或間接的(de)關系,但法律出于整體利益的(de)考慮,將(jiang)這些(xie)情形也納入了工(gong)傷(shang)范圍,視(shi)同工(gong)傷(shang)。這些(xie)視(shi)同工(gong)傷(shang)的(de)情形包括:

(一)在工作時間和工作崗(gang)位,突發疾病(bing)死亡(wang)或者在48小時之內經搶救無效死亡(wang)的

    (2)五級(ji)(ji)、六(liu)級(ji)(ji)傷(shang)(shang)殘(can)待遇。職工(gong)因工(gong)致殘(can)被(bei)鑒定為五級(ji)(ji)、六(liu)級(ji)(ji)傷(shang)(shang)殘(can)的(de),視為大部分喪失勞動能力,工(gong)傷(shang)(shang)職工(gong)保留與用人(ren)單位的(de)勞動關系(xi),并由用人(ren)單位安排適當工(gong)作。工(gong)傷(shang)(shang)職工(gong)還享受(shou)以下待遇:

    二是(shi)傷(shang)(shang)殘(can)(can)(can)津貼。如果用(yong)(yong)人單(dan)位(wei)難以(yi)安排傷(shang)(shang)殘(can)(can)(can)職工工作的(de)(de),則由(you)用(yong)(yong)人單(dan)位(wei)按(an)月(yue)發給傷(shang)(shang)殘(can)(can)(can)津貼,標準(zhun)是(shi):五級傷(shang)(shang)殘(can)(can)(can)為(wei)本(ben)人工資的(de)(de)70%,六(liu)級傷(shang)(shang)殘(can)(can)(can)為(wei)本(ben)人工資的(de)(de)60%,并由(you)用(yong)(yong)人單(dan)位(wei)按(an)照規定(ding)為(wei)其繳(jiao)納應繳(jiao)納的(de)(de)各項社會保(bao)險費(fei)。傷(shang)(shang)殘(can)(can)(can)津貼實際金(jin)額低(di)于當(dang)地(di)最低(di)工資標準(zhun)的(de)(de),由(you)用(yong)(yong)人單(dan)位(wei)補足差額。

    三是(shi)(shi)工(gong)(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)醫療(liao)補助(zhu)金和傷(shang)(shang)殘就(jiu)(jiu)(jiu)業補助(zhu)金。出(chu)于保(bao)護工(gong)(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)的(de)(de)目的(de)(de),《工(gong)(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)保(bao)險條(tiao)(tiao)例》規定工(gong)(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)與(yu)用(yong)(yong)人單(dan)位(wei)的(de)(de)勞(lao)動(dong)(dong)關系保(bao)留(liu),但是(shi)(shi),法律(lv)并(bing)沒有(you)限制工(gong)(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)解除(chu)或終(zhong)止(zhi)勞(lao)動(dong)(dong)合(he)同的(de)(de)權利(li),經工(gong)(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)本人提(ti)出(chu),可以(yi)與(yu)用(yong)(yong)人單(dan)位(wei)解除(chu)或者(zhe)終(zhong)止(zhi)勞(lao)動(dong)(dong)關系。考(kao)慮到(dao)工(gong)(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)勞(lao)動(dong)(dong)能(neng)力障(zhang)礙對就(jiu)(jiu)(jiu)業的(de)(de)影響,同時為了保(bao)障(zhang)工(gong)(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)在(zai)重(zhong)新就(jiu)(jiu)(jiu)業前有(you)必(bi)要(yao)的(de)(de)生活費(fei)及醫療(liao)費(fei),《工(gong)(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)保(bao)險條(tiao)(tiao)例》規定由(you)工(gong)(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)保(bao)險基金支付一次性(xing)(xing)工(gong)(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)醫療(liao)補助(zhu)金,由(you)用(yong)(yong)人單(dan)位(wei)支付一次性(xing)(xing)傷(shang)(shang)殘就(jiu)(jiu)(jiu)業補助(zhu)金。一次性(xing)(xing)工(gong)(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)醫疔補助(zhu)金和一次性(xing)(xing)傷(shang)(shang)殘就(jiu)(jiu)(jiu)業補助(zhu)金的(de)(de)具體標(biao)準由(you)省、自治區、直(zhi)轄市(shi)人民政府規定。

(3)七至十級傷(shang)殘待遇

    職工(gong)因工(gong)致殘被鑒定為七級(ji)至十級(ji)傷殘的,視為部分喪失勞(lao)動(dong)(dong)能力。除非(fei)工(gong)傷職工(gong)具有《勞(lao)動(dong)(dong)合(he)同法》第39條規定的情形,否(fou)則在勞(lao)動(dong)(dong)合(he)同期滿前用(yong)人單位應(ying)當與其繼續履行(xing)勞(lao)動(dong)(dong)合(he)同,或者依法變更勞(lao)動(dong)(dong)合(he)同。工(gong)傷職工(gong)還享受以下待遇(yu):

    一(yi)是(shi)傷(shang)殘補助(zhu)金(jin)。按傷(shang)殘等級(ji)從工(gong)傷(shang)保險(xian)基金(jin)中(zhong)支(zhi)付(fu)一(yi)次性傷(shang)殘補助(zhu)金(jin),標準(zhun)是(shi):七級(ji)傷(shang)殘為(wei)13個(ge)月的本人工(gong)資(zi),八(ba)級(ji)傷(shang)殘為(wei)11個(ge)月的本人工(gong)資(zi),九(jiu)級(ji)傷(shang)殘為(wei)9個(ge)月的本人工(gong)資(zi),十級(ji)傷(shang)殘為(wei)7個(ge)月的本人工(gong)資(zi)。

    二是工(gong)(gong)(gong)傷醫(yi)療補助金(jin)和傷殘就業補助金(jin)。勞(lao)動(dong)/聘用合同期滿終止(zhi),或者職(zhi)工(gong)(gong)(gong)本人(ren)提出解除勞(lao)動(dong)/聘用合同的,由工(gong)(gong)(gong)傷保險基金(jin)支付(fu)(fu)一(yi)(yi)(yi)次性工(gong)(gong)(gong)傷醫(yi)療補助金(jin),由用人(ren)單位支付(fu)(fu)一(yi)(yi)(yi)次性傷殘就業補助金(jin)。一(yi)(yi)(yi)次性工(gong)(gong)(gong)傷醫(yi)療補助金(jin)和一(yi)(yi)(yi)次性傷殘就業補助金(jin)的具體標準由省、自治區(qu)、直轄市人(ren)民政府規定。

    工(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)(shang)致殘(can)待遇中的(de)(de)傷(shang)(shang)(shang)殘(can)補(bu)助金(jin)(jin)和(he)傷(shang)(shang)(shang)殘(can)津貼的(de)(de)計(ji)(ji)發(fa)(fa)(fa)基數(shu)為(wei)(wei)“本(ben)人工(gong)(gong)(gong)(gong)(gong)資(zi)”,即(ji)工(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)(shang)職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)因工(gong)(gong)(gong)(gong)(gong)作(zuo)遭受(shou)(shou)事故傷(shang)(shang)(shang)害(hai)(hai)或(huo)(huo)(huo)者(zhe)患(huan)(huan)職(zhi)(zhi)業(ye)(ye)(ye)(ye)病(bing)(bing)前12個(ge)月(yue)(yue)平(ping)(ping)(ping)均(jun)(jun)月(yue)(yue)繳(jiao)費(fei)工(gong)(gong)(gong)(gong)(gong)資(zi)。本(ben)人工(gong)(gong)(gong)(gong)(gong)資(zi)高于統(tong)籌地(di)區職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)平(ping)(ping)(ping)均(jun)(jun)工(gong)(gong)(gong)(gong)(gong)資(zi)300%的(de)(de),按(an)照(zhao)統(tong)籌地(di)區職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)平(ping)(ping)(ping)均(jun)(jun)工(gong)(gong)(gong)(gong)(gong)資(zi)的(de)(de)300%計(ji)(ji)算;本(ben)人工(gong)(gong)(gong)(gong)(gong)資(zi)低于統(tong)籌地(di)區職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)平(ping)(ping)(ping)均(jun)(jun)工(gong)(gong)(gong)(gong)(gong)資(zi)60%的(de)(de),按(an)照(zhao)統(tong)籌地(di)區職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)平(ping)(ping)(ping)均(jun)(jun)工(gong)(gong)(gong)(gong)(gong)資(zi)的(de)(de)60%計(ji)(ji)算。對于曾經從(cong)事接觸(chu)(chu)職(zhi)(zhi)業(ye)(ye)(ye)(ye)病(bing)(bing)危(wei)害(hai)(hai)作(zuo)業(ye)(ye)(ye)(ye)、當(dang)時沒有發(fa)(fa)(fa)現罹患(huan)(huan)職(zhi)(zhi)業(ye)(ye)(ye)(ye)病(bing)(bing),辦理退休(xiu)(xiu)手續后(hou)未再從(cong)事接觸(chu)(chu)職(zhi)(zhi)業(ye)(ye)(ye)(ye)病(bing)(bing)危(wei)害(hai)(hai)作(zuo)業(ye)(ye)(ye)(ye)的(de)(de)退休(xiu)(xiu)人員被診斷或(huo)(huo)(huo)鑒(jian)定(ding)(ding)為(wei)(wei)職(zhi)(zhi)業(ye)(ye)(ye)(ye)病(bing)(bing),經工(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)(shang)認定(ding)(ding)和(he)勞(lao)(lao)動(dong)能(neng)力(li)鑒(jian)定(ding)(ding),符合領取(qu)一(yi)次(ci)(ci)性(xing)(xing)傷(shang)(shang)(shang)殘(can)補(bu)助金(jin)(jin)條件(jian)的(de)(de),按(an)就高原(yuan)則以本(ben)人退休(xiu)(xiu)前12個(ge)月(yue)(yue)平(ping)(ping)(ping)均(jun)(jun)月(yue)(yue)繳(jiao)費(fei)工(gong)(gong)(gong)(gong)(gong)資(zi)或(huo)(huo)(huo)者(zhe)確診職(zhi)(zhi)業(ye)(ye)(ye)(ye)病(bing)(bing)前12個(ge)月(yue)(yue)的(de)(de)月(yue)(yue)平(ping)(ping)(ping)均(jun)(jun)養老金(jin)(jin)為(wei)(wei)基數(shu)計(ji)(ji)發(fa)(fa)(fa)。曾經從(cong)事接觸(chu)(chu)職(zhi)(zhi)業(ye)(ye)(ye)(ye)病(bing)(bing)危(wei)害(hai)(hai)作(zuo)業(ye)(ye)(ye)(ye)、當(dang)時沒有發(fa)(fa)(fa)現罹患(huan)(huan)職(zhi)(zhi)業(ye)(ye)(ye)(ye)病(bing)(bing),勞(lao)(lao)動(dong)或(huo)(huo)(huo)聘(pin)用合同(tong)(tong)(tong)期滿后(hou)或(huo)(huo)(huo)者(zhe)因本(ben)人提出而解除勞(lao)(lao)動(dong)或(huo)(huo)(huo)聘(pin)用合同(tong)(tong)(tong)后(hou)未再從(cong)事接觸(chu)(chu)職(zhi)(zhi)業(ye)(ye)(ye)(ye)病(bing)(bing)危(wei)害(hai)(hai)作(zuo)業(ye)(ye)(ye)(ye)的(de)(de)人員被診斷或(huo)(huo)(huo)鑒(jian)定(ding)(ding)為(wei)(wei)職(zhi)(zhi)業(ye)(ye)(ye)(ye)病(bing)(bing),經工(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)(shang)認定(ding)(ding)和(he)勞(lao)(lao)動(dong)能(neng)力(li)鑒(jian)定(ding)(ding),被鑒(jian)定(ding)(ding)為(wei)(wei)一(yi)級至(zhi)十級傷(shang)(shang)(shang)殘(can),按(an)《工(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)(shang)保險條例(li)》規(gui)定(ding)(ding)應以本(ben)人工(gong)(gong)(gong)(gong)(gong)資(zi)作(zuo)為(wei)(wei)基數(shu)享(xiang)受(shou)(shou)相關待遇的(de)(de),按(an)本(ben)人終止或(huo)(huo)(huo)者(zhe)解除勞(lao)(lao)動(dong)、聘(pin)用合同(tong)(tong)(tong)前12個(ge)月(yue)(yue)的(de)(de)月(yue)(yue)平(ping)(ping)(ping)均(jun)(jun)繳(jiao)費(fei)工(gong)(gong)(gong)(gong)(gong)資(zi)計(ji)(ji)發(fa)(fa)(fa)。另外,職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)在同(tong)(tong)(tong)一(yi)用人單位連續工(gong)(gong)(gong)(gong)(gong)作(zuo)期間多次(ci)(ci)發(fa)(fa)(fa)生工(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)(shang)的(de)(de),符合《工(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)(shang)保險條例(li)》規(gui)定(ding)(ding)的(de)(de)可以享(xiang)受(shou)(shou)五、六級傷(shang)(shang)(shang)殘(can)待遇或(huo)(huo)(huo)者(zhe)七級至(zhi)十級傷(shang)(shang)(shang)殘(can)待遇時,按(an)照(zhao)其在同(tong)(tong)(tong)一(yi)用人單位發(fa)(fa)(fa)生工(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)(shang)的(de)(de)最高傷(shang)(shang)(shang)殘(can)級別(bie)計(ji)(ji)發(fa)(fa)(fa)一(yi)次(ci)(ci)性(xing)(xing)傷(shang)(shang)(shang)殘(can)就業(ye)(ye)(ye)(ye)補(bu)助金(jin)(jin)和(he)一(yi)次(ci)(ci)性(xing)(xing)工(gong)(gong)(gong)(gong)(gong)傷(shang)(shang)(shang)醫(yi)療補(bu)助金(jin)(jin)。

(三(san))因(yin)工死亡(wang)待遇

    職(zhi)工(gong)因工(gong)死亡,包括傷(shang)殘職(zhi)工(gong)在停工(gong)留薪期內因工(gong)死亡的(de),其近親屬可以從工(gong)傷(shang)保險基金領(ling)取(qu)以下待(dai)遇:

1、喪葬補助金。喪葬補助金為6個月的統(tong)籌地區上(shang)年度職(zhi)工月平均工資。2、供養親屬(shu)撫恤金。3、工亡補助金。

一級(ji)(ji)(ji)至四(si)級(ji)(ji)(ji)傷(shang)(shang)(shang)殘職工(gong)(gong)在停工(gong)(gong)留薪(xin)期(qi)滿后(hou)死亡的(de)(de),其近親(qin)(qin)屬只可以(yi)享受(shou)喪(sang)葬補(bu)助(zhu)金(jin)和供養親(qin)(qin)屬撫恤金(jin),這主要(yao)是因為傷(shang)(shang)(shang)殘職工(gong)(gong)被鑒定(ding)傷(shang)(shang)(shang)殘等級(ji)(ji)(ji)后(hou)可以(yi)享受(shou)一次(ci)性(xing)(xing)(xing)傷(shang)(shang)(shang)殘補(bu)助(zhu)金(jin),這與一次(ci)性(xing)(xing)(xing)工(gong)(gong)亡補(bu)助(zhu)金(jin)的(de)(de)性(xing)(xing)(xing)質相同(tong)。工(gong)(gong)傷(shang)(shang)(shang)職工(gong)(gong)死亡的(de)(de),一次(ci)性(xing)(xing)(xing)傷(shang)(shang)(shang)殘補(bu)助(zhu)金(jin)將作為遺產由其近親(qin)(qin)屬繼承

(四(si))停止享受工傷保(bao)險待遇(yu)情形

    工(gong)(gong)(gong)傷職工(gong)(gong)(gong)或其供養親屬享(xiang)受工(gong)(gong)(gong)傷保險待(dai)遇(yu)(yu)(yu)需要(yao)具(ju)備(bei)一定(ding)的條(tiao)件(jian),當條(tiao)件(jian)不具(ju)備(bei)或喪失了享(xiang)受待(dai)遇(yu)(yu)(yu)的前(qian)提(ti)時,工(gong)(gong)(gong)傷職工(gong)(gong)(gong)或其供養親屬將停止享(xiang)受工(gong)(gong)(gong)傷保險待(dai)遇(yu)(yu)(yu)。具(ju)體情形(xing)如下(xia):

1、喪失享(xiang)受(shou)待遇條件(jian)的(de)。2、拒(ju)不接受(shou)勞(lao)動能力鑒(jian)定的(de)。3、拒(ju)絕治(zhi)療的(de)。
